Terms of Service

These Terms of Service ("Terms") govern your use of Whispen, an AI-powered keyboard application for iOS ("Service"), operated by Whispen ("we," "our," or "us").

By using Whispen, you agree to these Terms. If you do not agree, do not use the Service.

Whispen is a keyboard extension for iOS that provides voice-to-text transcription powered by OpenAI's Whisper AI, along with smart formatting and translation features. The keyboard works within any app on your device.

Whispen uses AI (OpenAI's Whisper) for speech-to-text transcription. While we strive for accuracy, transcription output is not guaranteed to be 100% accurate. You are responsible for reviewing and verifying all transcribed text before use.

Whispen is not intended for and should not be relied upon for:
• Medical transcription or health-related documentation
• Legal proceedings or legal documentation
• Safety-critical communications
• Any use where transcription errors could cause harm

By using Whispen, you acknowledge that AI transcription may contain errors and accept responsibility for verifying output.

Whispen offers subscription plans billed through Apple's App Store:

• Normal Plan: $4.99/month or $49/year
• Pro Plan: $9.99/month or $99/year
• Free Trial: All plans include a 7-day free trial. Payment method is required upfront.

Auto-Renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation: You can cancel anytime through Settings → Apple ID → Subscriptions. You will retain access until the end of your current billing period. Refunds are handled by Apple per their refund policy.

You agree not to:

• Use Whispen for any illegal purpose
• Attempt to reverse-engineer, decompile, or disassemble the app
• Interfere with or disrupt the Service
• Use Whispen to generate or transmit harmful, abusive, or harassing content
• Resell or redistribute the Service

Whispen, including its design, code, and branding, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the app for personal purposes.

Content you create using Whispen (transcriptions, translations) belongs to you.

You agree to indemnify and hold harmless Whispen, its officers, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

To the maximum extent permitted by law, Whispen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We may update these Terms from time to time. When we make significant changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via in-app notification where practicable

Continued use of Whispen after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you should stop using the Service and cancel your subscription.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.
